Actress Asia Argento, one of the best known #MeToo activists after she told the New Yorker that Weinstein had raped when she was 21, is being looked at for the sexual assault of a young actor, Jimmy Bennett in 2013. He was 17 at the time, which is underage under California law and she’d have been around 38. The New York Times alleges she settled a legal notice of intent to sue for $380,000 shortly after she said that Harvey Weinstein raped her.
They co-starred in 2004 in The Heart Is Deceitful Above All Things in which Argento played Bennett’s prostitute mother. Bennett claimed he had been traumatised by the encounter and it had hurt his career; no police report was filed at the time. Weinstein has been indicted on sex crime accusations involving three women, but not including Argento – all of which he denies.

California Authorities are not investing this, so no, not criminally prosecutable there for some reason, even if the age of consent is 18. One amendment most US States make is that you can actually have sex with an underage spouse, and many States still allow underage marriages. In New Hampshire and Florida you could marry at 13 (!) with a parental permission up until this year. Many European countries have, of course, significatively lower ages of consent, and some do not even recognize “statutory rape”, but may use other terms.
That said, Ms. Argento denies allegations. Paying a non-victim may seem suspect, so she tells it was a dead man’s (Tony Bourdain) idea to pay Jarrett to avoid “bad publishity”. I personally don’t think it’s either classy or good media strategy. How did her lawyers not see Weinstein, who employed ex-Mossad agents to dig dirt on her not to find out about this? While I don’t think this hurts #metoo movement in general – we now have POTUS’s personal lawyer telling that yes, he paid off women on his urging -, this is not a good development for this movement in Italy. Most Italians seem to think she’s “pazza”, remembering a very nasty custody battle she had for her daughter and her muscian ex-husband basicly going quiet for years as the result. This completely plays into that narrative.
